LCA Filing Requirements for Multi-Site and Work-from-Home Cloud Engineers

Distributed delivery is now the default in cloud consulting. Engineers rotate between a client's data center during cutover weeks, a regional office for design workshops, and a home office for the long stretches of automation work in between. Each of those locations is a worksite for labor condition application purposes, and each carries prevailing wage and notice consequences. The compliance failure is rarely deliberate; it is almost always the result of a staffing decision made quickly to meet a delivery date, with the wage and posting analysis happening weeks later. Building the check into the staffing workflow is far cheaper than remediating afterward.

Every Location Is a Worksite

A home office in a different metropolitan statistical area than the certified worksite generally requires a new LCA at that area's prevailing wage. Short-term placement rules can cover limited travel, but they are bounded by day counts and cannot be used to normalize an indefinite arrangement that has quietly become the engineer's regular workplace.

Prevailing Wage Across Markets

Wage levels differ sharply between metros, so the same architect can be compliant in one market and underpaid in another after a move. The required wage is the higher of the prevailing wage for the area of intended employment and the actual wage paid to similarly employed workers at the firm.

Notice and the Public Access File

Notice must be provided at each place of employment, including electronic notice for remote arrangements, and the public access file must be complete within one working day of filing and retained for the required period. Files that are technically assembled but scattered across systems tend to fail when they are actually requested.
